1. Acceptance of Terms
Amoriale (“we,” “us,” “our”) operates the Site and offers custom tribute and memorial products. If you do not agree to these Terms, do not use the Site or purchase from us. We may update these Terms from time to time by posting the updated version on this page.
2. The Biological Process & Natural Tolerances
You acknowledge that Amoriale products are bespoke and cultivated from biological materials (hair or fur). Because our Chemical Vapor Deposition (CVD) process mimics nature, absolute uniformity cannot be guaranteed. Variations in output are the hallmark of a natural growth process and are not considered manufacturing defects.
- Carbon Yield: Biological materials vary in carbon concentration. If a provided sample does not yield enough pure carbon to safely grow the requested carat size, we reserve the right to either cultivate a smaller diamond (refunding the cost difference) or, only with your explicit written consent, supplement the growth with highly purified generic lab carbon.
- Color & Clarity Variance: Trace elements naturally present in hair and fur influence the final hue and clarity. Exact microscopic color shades and inclusion patterns cannot be guaranteed.
- Carat Weight Variance: Final output may vary within reasonable gemological tolerances (a target range of +/- 10% of the ordered weight).
- Third-Party Certification: We rely on independent gemological laboratories (such as IGI) for certification. Gemological grading contains subjective elements, and we are not liable for slight variances in opinion from outside appraisers.
3. Handling of Sentimental Materials & Liability
We treat every lock of hair and fur with the utmost reverence and dignity. However, to operate our service, we must establish strict liability boundaries regarding the transit and handling of these irreplaceable items.
- Warrant of Ownership: By submitting materials to us, you legally warrant that you are the rightful owner or authorized custodian of the hair or fur and have the legal authority to commission this service.
- Transfer of Risk: The risk of loss remains with you while the collection kit is in transit to our facilities. Risk transfers to Amoriale only upon confirmed, physical delivery at our lab.
- Limitation of Liability for Sentimental Value: To the maximum extent permitted by law, Amoriale is not liable for damages related to emotional distress, sentimental value, or irreplaceable loss. In the unlikely event that materials are lost, damaged, or destroyed while in our possession, our total financial liability is strictly capped at the total amount you have paid to Amoriale for the specific order.
4. Cancellations, Refunds, and Abandonment
Because our diamonds are bespoke and cultivated specifically from your personal materials, they hold no resale value. Standard e-commerce return policies do not apply.
- Phased Non-Refundability: You may cancel your order for a full refund within 7 days of your initial deposit, provided the collection kit has not been used or returned to us. Once carbon purification begins, a portion of your payment becomes non-refundable. Once diamond growth commences in the reactor, the order is 100% non-refundable. Completely finished diamonds cannot be returned.
- Abandonment of Goods: If your diamond is completed and you fail to pay the final balance, or if you become unreachable for a period of 90 days despite multiple documented contact attempts, Amoriale reserves the right to cancel the contract, retain all deposits, and legally dispose of or take ownership of the diamond. Unused hair or fur will also be respectfully disposed of after this period.
5. Timelines and Force Majeure
All production timelines communicated (e.g., 7 to 10 months) are good-faith estimates, not guarantees. We will not be held liable for delays caused by the natural pace of diamond growth, third-party certification queues, global shipping disruptions, or acts of God (Force Majeure).
6. Media and Marketing Rights
Unless you explicitly opt out in writing, Amoriale reserves the right to anonymously photograph or video the finished diamond and its jewelry setting for marketing, social media, and website purposes. We will never use your name, face, or personal identifiers in marketing without your separate, explicit written consent.
7. Orders, Pricing, and International Operations
Prices are shown at checkout. We reserve the right to refuse or cancel orders in cases of suspected fraud. While Amoriale is a U.S. entity, certain fulfillment and cutting steps may be performed by specialized partners internationally (including in India). By purchasing from us, you acknowledge that processing and related logistics may occur internationally as necessary to fulfill your order.
8. Disclaimers & General Limitation of Liability
To the maximum extent permitted by law, the Site and services are provided “as is” and “as available.” Amoriale will not be liable for indirect, incidental, special, or consequential damages arising from the use of our site or services.
9. Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of New York, without regard to conflict of law principles. Before filing a formal claim, you agree to contact us at care@amoriale.com to attempt a resolution. If a dispute cannot be resolved, it must be handled through binding arbitration or brought in state or federal courts located in New York, NY, unless applicable law requires otherwise.
